Dr. Hassan Mohi-ud-Din Qadri’s addresses Peshawar High Court Bar Association
Chairman of the Supreme Council of Minhaj-ul-Quran International, Dr. Hassan Mohi-ud-Din Qadri, during his address to the Peshawar High Court Bar Association, emphasized the significance of the "Constitution of Medina" and its concept of a welfare state as discussed in his book.
He explained that the Constitution of Medina is not just a treaty but the first written constitution in history. In his book, he derived 73 constitutional principles from the 63 articles of the Constitution of Medina, comparing them with the constitutions of the U.S., U.K., and Europe to demonstrate that the constitution given by Prophet Muhammad (PBUH) over 1400 years ago is superior to all modern constitutions.
Dr Hassan Mohi-ud-Din Qadri said that the importance of this book and the motivation behind it can be understood from an incident where Justice (R) Javed Iqbal, son of Allama Iqbal, once asked Dr. Muhammad Tahir-ul-Qadri whether the Constitution of Medina, which some orientalists and philosophers considered just a treaty, could truly be classified as a constitution. Dr. Tahir-ul-Qadri clarified that the constitutional and legal aspects of the Constitution of Medina could be established through a comparative study with modern constitutions. Under this guidance, Dr. Hassan Mohi-ud-Din Qadri undertook the significant task of proving that the "Covenant of Medina" was, indeed, a written constitution.
In his book, Dr. Hassan meticulously elaborated on the model of the state of Medina, providing extensive references on its administrative, economic, judicial, law and order, intelligence, freedom of speech, and human rights systems, including the rights of the poor and needy. He argued that the modern world’s organized concepts of human rights, the religious, linguistic, political, and social rights of minorities, and the welfare state originated from the Constitution of Medina and the state of Medina.
Dr. Hassan further explained that the Prophet Muhammad (PBUH) established a system of public welfare in the state of Medina, ensuring that wealthier tribes would support the financially weak ones, and if a tribe could not help its members, the state would step in. The Prophet (PBUH) also emphasized that the law would be equal for everyone, regardless of their status.
The Constitution of Medina was not just theoretical but was practically implemented during the Prophet’s (PBUH) 10 years in Medina, proving its viability. Dr. Hassan stated that the constitutional principles laid out in the Constitution of Medina serve as a model for modern states and stand as evidence that it is the first written constitution in the world.
Dr. Hassan concluded that if Pakistan properly studied and implemented the Constitution of Medina, it would not be long before the country regained its lost dignity.
